TERMS AND CONDITIONS
Please read these Terms carefully before registering or bidding.
1. INTRODUCTION
1.1 Binding Agreement
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“Bidder,” “Buyer,” or “you”) and Bid Boss Inc. (“Bid Boss,” “we,” “us,” or “our”). These Terms govern your registration, bidding, purchase of lots, payment, pickup, shipping, and any related services provided through the Bid Boss auction platform.
By registering, placing a bid, or purchasing any lot, you confirm that you have read, understood, and agree to be bound by these Terms in full.
1.2 Incorporated Policies
All supplementary policies referenced herein, including but not limited to the Privacy Policy, Shipping Policy, and auction-specific rules, are incorporated by reference and form part of these Terms. In the event of any conflict, these Terms prevail unless expressly stated otherwise.
2. ELIGIBILITY AND REGISTRATION
2.1 Eligibility
You must be at least eighteen (18) years of age and have full legal capacity to enter into binding contracts.
2.2 Account Information
You agree to provide true, accurate, and complete information during registration. Failure to maintain accurate information may result in suspension or termination.
2.2 Account Security
You are solely responsible for all activity conducted through your account and for safeguarding your credentials.
3. COMMUNICATIONS AND NOTICES
3.1 Electronic Communications
By registering, you consent to receive communications via email, phone, or SMS related to auctions, invoices, scheduling, and policy updates.
3.2 Marketing Communications
You may opt out of marketing communications at any time. Transactional notices are mandatory.

4. AUCTION CONDUCT AND BIDDING
4.1 Binding Bids
All bids are firm, irrevocable offers to purchase and cannot be cancelled or modified.
4.2 As-Is Sales & Limited Coverage
All lots are sold “AS IS, WHERE IS.” Coverage applies only to Grade A & B items for major functional defects or INAD claims.
4.3 Bidder Due Diligence
You are responsible for reviewing all photos, descriptions, and condition grades prior to bidding. Bidder remorse is not permitted.
4.4 Auctioneer Discretion
Bid Boss reserves the right to reject bids, cancel auctions, or disqualify bidders at its sole discretion.
4.5 Technical Issues
Bid notifications are not guaranteed. Bid Boss is not liable for technical interruptions.
5. PAYMENT AND INVOICING
5.1 Settlement Invoice
Invoices include hammer price, buyer’s premium, handling fees, taxes, and shipping if applicable.
5.2 Accepted Payment Methods
- Visa / Mastercard
- Debit Card
- Interac e-Transfer
- Cash (in person)
American Express is not accepted.
5.3 Payment Default
Failure to pay within 48 hours constitutes default and may result in forfeiture and account termination.
5.4 Identification Requirement
Government-issued photo ID is required for first-time buyers or invoices over CAD $200.
5.5 Currency & Taxes
All prices are in CAD. Ontario HST (13%) applies unless exemption is provided in advance.
6. DEFAULT, ABANDONMENT & REMEDIES
All items must be picked up or shipped by Saturday at 3:00 PM following the auction. Late items are abandoned and forfeited without refund.
7. PICKUP, SHIPPING & RISK
7.1 Pickup
Pickup is by appointment only. Signature and ID are required.
7.2 Loading & Risk
Buyers are responsible for loading. Risk transfers upon release.
7.3 Shipping
Shipping must be requested. Fees must be paid before release. U.S. buyers are responsible for duties and customs.
RETURNS AND REFUNDS
Only Grade A & B items qualify for limited claims within 24 hours. Handling and shipping fees are non-refundable.
ITEM CONDITION & GRADING
- New / Overstock – Factory sealed
- Grade A – Opened, no defects
- Grade B – Minor cosmetic wear
- Grade C – Noticeable wear or missing parts
- Grade D – Non-functional (parts/repair)
LIMITATION OF LIABILITY
Bid Boss’s liability is limited to the hammer price paid. No indirect or consequential damages.
DISPUTE RESOLUTION
Governed by Ontario and Canadian law. Disputes resolved by binding arbitration in Toronto, Ontario.
